Requests To Relocate A Child Outside Of The Country In Melbourne, Florida

This is the first post in a series of articles discussing requests by Melbourne, Florida parents to move with a child outside of the country. We have previously a series about relocation requests when a parent desires to move outside of Florida. International requests typically receive a heightened degree of scrutiny given the additional difficulties for the other parent to maintain a meaningful relationship with the child. The goal is this series is to examine how such requests are evaluated by Florida courts and to review what parents can expect from the legal process. If you are considering an international relocation or would like to challenge the other parent’s desire to move, an experienced family law attorney can help you through the process. This series will review the following subjects:

  • When a court will approve or deny a request for international relocation
  • Factors considered in a court’s evaluation of a request to move outside of the country
  • The role of discovery in an international relocation case
  • What parents can expect at a relocation trial

These topics are important for a variety of reasons. First, relocation requests are among the most contentious disputes between parents. Given the challenges presented by an international move, the stakes are even higher. Before considering an international move, parents should understand the types of requests that may or may not receive court approval. Second, if seeking permission to move outside of the US, a parent should be familiar with the factors a judge will consider in their evaluation. It is imperative to include this information in your request. Third, should the case proceed to trial, discovery, or the process by which the parties can gather evidence, will become extremely important. Fourth, parents should have a basic understanding of what to expect during the trial process.
